Yes. Students with disabilities have special rights when facing disciplinary action by school officials. The law recognizes that sometimes their actions and behaviors are a result of their special needs, and therefore should be addressed differently than actions by students without disabilities. [1] [1] School procedures must conform to guidelines for discipline for students with disabilities in the Individuals with Disabilities Education Act, 20 U.S.C. § 1415(k). In DC and Maryland the special provisions for discipline of a student with a disability are in 5 DCMR § 2510, Md. Code, Education, § 7-305(f)(1) and COMAR § 13A.08.03 Chapter 03. Montgomery County policies are in Montgomery County Public Schools, Regulation JGA-RB, Suspension or Expulsion of an MCPS Student § VIII. Prince George’s County policies are in Prince George’s County Public Schools, Administrative Procedure 5164, Procedural Guidelines for Students With Disabilities Under Section 504 of Rehabilitation Act of 1973 § XI. |
